Georgia Court of Appeals Approves Braselton Hospital!

The Georgia Court of Appeals reinstated Northeast Georgia Medical Center’s (NGMC) Certificate of Need (CON) for a hospital in South Hall County on March 23, 2010.  The Court’s decision reversed the Barrow County Superior Court’s ruling issued in December 2008.

“We are extremely pleased that the Georgia Court of Appeals issued the decision,” said Jim Gardner, president and CEO of Northeast Georgia Health System (NGHS).  “The appellate ruling further reinforces the original decision made by the Georgia Department of Community Health in May 2007 and the two subsequent rulings which upheld that decision.”

Soon after the appellate court’s decision, though, NGMC was disappointed to learn that Barrow Regional Medical Center (BRMC) filed a notice of intent to appeal to the Georgia Supreme Court. 

BRMC’s next step would be to file a formal petition with the Court.  NGMC would have another 20 days to respond, then the Court would decide whether it agrees to hear the case.  Either way, the delay could take several months.

“We remain confident in our CON application, and the validation it has received through three appeals processes, and believe that it will prevail,” says Gardner.  “We are prepared to wait through this final stage of the journey while we continue to develop the River Place campus and begin study for the early design phase for the future hospital.”

NGMC plans to build a 100-bed hospital off of Thompson Mill Road near Highway 211, at River Place.  In September 2008, NGMC opened a medical office building on the corner of this site called Medical Plaza 1.  Medical Plaza 1 houses an urgent care center, an outpatient imaging center, outpatient lab and rehabilitation services and physician offices representing numerous specialties.
